Prospect Hospitality Co., Ltd. (hereinafter referred to as “the Company” or “we”) as the development licensee of McDonald's will respect the rights of every Internet user, including privacy and personal data protection, in the process of rendering restaurant and relevant services. To ensure that all users can browse or use the website and the app operated by McDonald's Taiwan and access relevant services with ease, we will collect, process and use the personal data of Internet users, safeguard such personal data and protect the privacy of these users according to the following commitment and declaration.
Data collected by the Company and methods of use
When Internet users access the website or app of McDonald's Taiwan operated by the Company, we may use cookies or similar tracking services (e.g., Google Analytics) to optimize the user experience, to accept the opinions of Internet users and to survey on the levels of consumers’ satisfaction, or to provide consumers with relevant food and beverage services (such as ordering, delivery, membership, parent-child bonding activities, complaints or reporting, and lucky draws). Personal data of Internet users is collected within the necessary scope for each purpose and this may include names, dates of birth, addresses, telephone numbers, emails, transaction information, website/app membership data, product preferences, social media accounts, locations and other data provided by users in the interaction process. The Company collects personal data directly from consumers and users on the website and the app, as well as from other resources such as social media and third-party partners. We process, use and retain all the collected personal data in accordance with the governance of relevant laws and this statement.
We welcome those who love the food and beverage industry and the McDonald’s culture to join McDonald's Taiwan. Internet users will be able to find out how to join McDonald's Taiwan and learn about relevant future developments from the Company website. The Internet users who are interested in joining McDonald's Taiwan will be able to submit resumes via the job sites we cooperate with. However, the collection, processing and use of Internet users’ personal data by these job sites are regulated by the privacy protection policies of the individual websites, not within the scope of privacy protection under this statement. Therefore, we urge Internet users to read in detail the privacy protection policy of the human resources site operated by other companies before providing personal data, to protect their own relevant rights.
Scope of sharable data of Internet users
Provided the adherence to the same agreement for privacy protection of Internet users, we allow the companies within the McDonald's group (including global headquarters and affiliated enterprises of McDonald's or franchised stores of McDonald's Taiwan) to use the data of Internet users. When consumers select “consent” to receive information of relevant products or services from McDonald's Taiwan, we will send consumers marketing messages about products or services (e.g., coupons and new product introduction) regularly and from time to time. If consumers are unwilling to receive such messages further, they can still cancel the consent and we will no longer send relevant messages. If consumers select “not consent” to receive relevant information, we will not send any marketing messages on any product or service to consumers.
Some of our suppliers will access the data of Internet users collected by the Company when they complete the ordering procedures, assist in marketing campaigns and provide technical services, etc. to the website. However, the scope of use shall be limited to the business specified by the Company.
We will not sell, transfer or divulge the relevant information of any Internet users to organizations outside the McDonald's group. With prior consent from consumers, we will occasionally send to consumers the product or service messages from our business partners. We will ask consumers in advance whether they consent to the receipt of any marketing information about our business partners. If they select “consent”, we will send the marketing information from our business partners to consumers, without providing consumers’ data to these businesses partners.
Under the following circumstances, we reserve the right to use or provide the data of Internet users. This includes legal regulations and requirements; maintenance of the integrity and lawfulness of the McDonald's Taiwan website, responding to the request from an Internet user; and cooperating with legal investigations and for public safety, etc.
About privacy protection of children
We spare no efforts in privacy protection. We are proud of our long-standing commitment to our customers. We have always been extra cautious and careful in communication with our most cherished customers – children.
Except for the parent-child bonding activity “Fun for McDonalds’ Children” shown on the website, we will not collect the personal data of children under 12 years old in the name of other campaigns or via other website/app. Meanwhile, we only accept the registration by children’s legal representatives (e.g., parents) for relevant parent-child bonding activities and only collect the personal data of children within the scope necessary for the organization of events. Despite these measures in place and considering the possibility of infringement of consumers’ privacy as a result of over-execution of identity and data verification, we are not able to fully prevent children from registering for relevant parent-child bonding activities themselves or by using the names of their legal representatives. When handling membership registrations or marketing activities, we may unknowingly accept the membership registration or event sign-up by children under 12 years old and end up retaining their personal data as a result of false dates of birth information provided to the McDonalds’ website or by social media such as Facebook and Instagram. We hence urge parents to gain an appropriate understanding and manage the Internet activities of children. Meanwhile, we promise that the Company and relevant cooperating companies shall stop the use of acquired personal data of children and delete such data immediately once we have identified the abovementioned dishonest behavior of children.
The children’s data collected shall be limited to use by the Company or by the Company’s cooperating partners when rendering technical or other relevant services to the Company (such as improvement of website contents, responding to customers’ requests or organizing lucky draws for the Company). No data of Internet users will be sold or transferred to any third party.
Regarding personal data
We strive to protect the personal data provided by each Internet user. Each user has the right to informational self-determination on the personal data they provide to the Company. They may inquire with the Company about their personal data or request duplication of such data about them according to the relevant rules prescribed by the Personal Data Protection Act. They may ask the Company to supplement or rectify their personal data in case of change in personal circumstances. They may ask the Company to delete or stop the processing and the use of their personal data when they no longer use the services provided by the Company. If consumers are children, we only accept and respond to the request from their legal representative (e.g., parents) in order to protect the rights of children.
We will balance between the protection of Internet users’ rights and the provision of convenient services, based on the business nature and the service menu, when we handle inquiries from Internet users and requests for supplementing, rectification or deletion of their personal data via telephone, over emails, with paper-based correspondence or through our official account on messaging apps, website or app. For example, the registered members may use the McDonald's Taiwan app operated by the Company to supplement or rectify their personal data on the app; cancel or subscribe to the newsletters or text messages about the updates on promotional offers; and request for deletion or modification of account data via written application forms. Moreover, Internet users may contact our Customer Care Department to inquire about personal data, request for supplementing, rectification or deletion of personal data or provide opinions or suggestions about relevant mechanisms. We will assist and respond to users appropriately, review the opinions or suggestions and adopt necessary measures.
