MyMcDonald’s Rewards McDonald’s x Stormzy Merch Redemption Terms

These Merch Redemption Terms describe the process for exchanging MyMcDonald’s Rewards points for branded merchandise as part of our McDonald’s x Stormzy Famous Orders promotion (the “Merch Redemption Terms”). The MyMcDonald’s Rewards Famous Orders x Stormzy merch redemption promotion (“Promotion”) is operated by McDonald’s Restaurants Limited (“McDonald’s”, “we”, “us” or “our”). Please read these terms carefully. If you do not agree to all of the Merch Redemption Terms, please do not take part in the Promotion.

1. Rewards Program. The Merch Redemption Terms are intended to supplement the MyMcDonald’s Rewards (UK) Terms and Conditions (“MyMcDonald’s Rewards Terms”). You understand and acknowledge that you have already agreed to the MyMcDonald’s Rewards Terms when you opted in to the MyMcDonald’s Rewards program and the MyMcDonald’s Rewards Terms along with our Terms and Conditions for McDonald’s Online Services (UK) remain binding.  

2. McDonald’s Privacy Statement. In connection with these Merch Redemption Terms, McDonald’s will use your personal data as set out in our Privacy Statement, which forms part of these terms. Our Privacy Statement describes our information practices, including how we collect, use and share your personal information. It also sets out rights that you have in respect of your personal information.

3. Eligibility. To be eligible to take part in the Promotion, you must be 18 years old or over, have opted in to email marketing and MyMcDonald’s Rewards on the McDonald's (UK) app and have a sufficient number of MyMcDonald’s Rewards points to exchange for a merchandise item. Please ensure that you have access to the email address which you used to sign in to the McDonald's (UK) app.

4. Merch Stock Availability. The Promotion commences at  15:00 on 26th February 2025. Rewards are subject to availability and merch stock availability is limited. Merch rewards are only available whilst stocks last, and rewards may be removed or changed at any time. Rewards are for domestic and private use only. Each McDonald’s x Stormzy Merch item will be made available from the dates and times set out in the table below, until 23:59 on 1st April or until stock last.

5. App required. Rewards points can only be exchanged for merchandise via the McDonald's (UK) app. Redemption only available when customer accesses its McDonald's (UK) app from inside a restaurant. Merch rewards CANNOT be obtained or collected in any restaurant or via McDelivery®.

6. Products can vary slightly – The appearance of products may not exactly match that shown in our app, on our website or in our marketing (for example, the true colours may vary from those shown on a device or product packaging may be slightly different). 

7. Exchanging your points for Merch rewards. If you have enough points for a merch reward, the reward will be unlocked in the Rewards Menu in the ‘Rewards & Offers’ section of the McDonald's (UK) app when you are located inside a restaurant. You can exchange your points for a maximum of 5 merch rewards per transaction. There are 2 steps to complete to exchange your points for a merch reward:

(a) select the reward from the Rewards Menu, choose either 'Add to Pickup Order' or 'Add to your code’ (chosen option does not affect merch reward process) and complete the reward selection process in the app - when you complete the reward selection process within the McDonald's (UK) app, the number of points required for the corresponding reward(s) will be deducted from your Rewards account; and

(b) if the reward checked out within the app is in stock, an email containing a link to a merch order claim form will be sent to you within one hour (using the email address which you used to sign in to the app) – please open this link and complete and submit the subsequent claim form by 23:59 on 1st April 2025 as we require the details in order to be able to deliver the reward. 

If you ordered more than one merch reward as part of the reward selection process in the app, an email containing a link to a merch order claim form will be sent to you for each piece of merchandise (provided the chosen reward is in stock). A separate merch order claim form must be completed for each piece of merchandise.

If you have not received a merch order claim form by email within 1 hour of completing the reward selection process within the app, please promptly contact Customer Services by email at  merchquery@mcdonalds.zendesk.com

8. Order Checks. If you place an order for a merch reward, we are not obliged to accept that order. Sometimes we need to reject reward selections submitted within the McDonald's (UK) app, for example, because a piece of merchandise is unavailable or out of stock, you are located outside the UK, we reasonably suspect the order is related to fraudulent activity or the reward was listed in an incorrect tier of the Rewards Menu. We only accept your merch reward order when we dispatch the corresponding piece of merchandise to you. As a result, the contract between you and us will only be formed and completed upon actual dispatch of the applicable piece of merchandise to you (and completion of the reward selection process within the app or submission of the merch order claim form does not constitute our acceptance of your order). 

9. Delivery. We can only deliver merch rewards to addresses within the United Kingdom. We will use reasonable efforts to deliver a reward within 30 days from completion of the corresponding merch order claim form but will not be liable for any failure to meet that timeframe.

10. Separate Deliveries. Each merch reward will be delivered separately, even the items formed part of the same merch reward selection order submitted within the app (and in that case each piece of merch will be treated as being delivered as an instalment and forming a separate contract between you and us). Any delay in delivery or defect in an instalment of merch shall not entitle you to cancel any other instalment of merch.

11. Return of Points if Order is Rejected or Claim Form Not Submitted. If we need to reject your order for a merch reward or you don’t complete and submit a merch order claim form for a piece of merchandise redeemed as a reward within the McDonald’s (UK) app by 23:59 on 1st April 2025 we shall treat the order for that piece of merchandise as cancelled and reinstate the number of Rewards points deducted from your Rewards account for that reward by no later than 23:59 on 15th April 2025. No cash or other alternative is available.

12. Product Faults. We have a legal duty to provide you with products that are as described to you on our app and meet all the requirements imposed by law. If you think there is something wrong with your merch reward, you must contact our Customer Services Team via the email found on the comp slip attached to your package within 30 days of the product being dispatched. We may require you to provide clear photographic evidence of any faults. Depending on the outcome, we may then process a return of your merchandise (and you will be required to return the merchandise back to us within 14 days). Merchandise cannot be exchanged. Merch rewards CANNOT be returned to a restaurant.

13. If you Change your Mind and wish to Return your Merchandise. If you change your mind and wish to return your merch reward after receipt, you must contact our Customer Services Team via the email found on the comp slip attached to your package within 30 days of the product being delivered. Our Customer Services Team will notify you of the returns address to which you must post back your merchandise. You must return the merchandise to us within 14 days of receiving the return address details from Customer Services. You will be responsible for all costs of returning the merchandise to us and merchandise must be returned unused and in good condition. We will not be responsible for merchandise that is lost or damaged in the post (and we would advise that you use a delivery service that offers proof of postage). Provided that we receive the merchandise in a good unused condition, we will reinstate the number of Rewards points deducted from your Rewards account for that reward by 23:59 on 15th April 2025 . Merchandise cannot be exchanged. Merch rewards CANNOT be returned to a restaurant. 

14. Events beyond our control. We're not responsible for failure to perform any of our obligations under these Merch Redemption Terms caused by an event outside our reasonable control (such as but not limited to adverse weather conditions or acts of God). If such an event occurs, then McDonald’s obligations under these terms will be suspended for the duration of the event and we aim to use reasonable endeavours to find a solution by which our obligations under these terms may be performed despite the event.

15. Responsibility for Loss or Damage.  

(a) McDonald’s and its agents assume no responsibility and are not liable for interception or interference with, late or non-receipt of, or corruption or damage to, any communication in connection with the Promotion.

(b) You agree not to use the Promotion or any merchandise provided as part of the Promotion for any commercial, business or resale purposes, and we shall not have any liability to you for any loss that you suffer as a result of any such use. 

(c) We shall not be responsible for any losses or damage that is not an obvious consequence of our breach, that was not contemplated by you and us at the time that you took part in the Promotion or that was something you could have avoided by taking reasonable action, including following our reasonable instructions for use. 

(d) McDONALD'S SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT LOSS OF PROFITS, BUSINESS LOSSES, LOST DATA, PROPERTY DAMAGE OR SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL LOSSES OR DAMAGES OF ANY KIND RELATED TO OR ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE PROMOTION OR USE OF A REWARD. 

(e) If we are liable to you in relation to your participation in the Promotion (whether in contract, tort (including negligence) or otherwise), our maximum liability to you will be £50. 

(f) McDonald’s reserves all legal rights to recover damages or other compensation under these terms or as allowed by law. 

(g) Nothing in these Merch Redemption Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence or for any other matter that we cannot exclude or limit under applicable law. Additionally, nothing in these Merch Redemption Terms shall affect your legal rights.

16. Other Important Terms

(a) All intellectual property rights in the merchandise, including all designs, trademarks, brand names, images and logos, are and shall remain our property, or those of our licensors.

(b) Each of the terms and conditions in these Merch Redemption Terms operates separately. If a court or other authority decides that some of these terms are unlawful, void or unenforceable, then the rest will continue to apply. 

(c) If McDonald’s fails to insist that you perform any of your obligations under these terms, or if McDonald’s does not enforce its rights against you, or delays in doing so, that will not mean that McDonald’s has waived its rights against you and will not mean that you do not have to comply with those obligations.

(d) These Merch Redemption Terms govern the relationship between McDonald’s and you. These Merch Redemption Terms are not intended to be relied upon by any third party. 

17. Applicable Law and Courts. These Merch Redemption Terms will be governed and interpreted pursuant to English law. You irrevocably consent to the exclusive jurisdiction of the courts in England and Wales for purposes of any legal action arising out of or related to these terms.
