McDonald’s Customer Survey Prize Draw Terms And Conditions

These are the terms and conditions (“Terms”) that apply to the Customer Survey Prize Draw (“Promotion”). By entering the Promotion, each participant agrees to these Terms and confirms they have read and understood the McDonald’s Privacy Notice at www.mcdonalds.com/gb/en-gb/privacy-policy.html. Please see how we limit our liability in the “Liability” section below.

1. Promoter: McDonald’s Restaurants Limited, a company registered in England (company no. 01002769) with its registered office address at 11-59 High Road, East Finchley, London, N2 8AW (“Promoter”). 

2. Promotion administrator: Promoter has engaged W & J Linney Limited, a company registered in England (company no. 00137552) with its registered office address at Adamsway, Mansfield, Nottinghamshire NG18 4FL to assist with the administration of the Promotion, including prize fulfilment (“Promotion Administrator”). 

3. Entry period: The Promotion opens for entry at 18:00 on 20th August 2024 and closes at 23:59 on 6th September 2024 (“Entry Period”).

4. Eligibility: Entry is by invite only and is only open to consumers (not businesses). To be eligible for the Promotion, participants must be the named recipient of an email from Promoter inviting them to participate in the customer survey. Participants must also be legal residents of the United Kingdom (England, Wales, Scotland and Northern Ireland) and at least 18 years old at the time of entry. The Promotion is not open to employees and contractors of Promoter, Promotion Administrator or any prize provider, their immediate families and households and anyone else professionally involved or associated with the Promotion. Promoter reserves the right at any time to require proof of eligibility in such form as Promoter reasonably considers necessary.

5. Limit on number of entries: A limit of one (1) entry per person applies to this Promotion. Promoter reserves the right at any time to disqualify anyone found to have entered more than once, including by using multiple accounts or email addresses.

6. How to enter: To enter the Promotion, eligible participants must do the following during the Entry Period: (i) click the link in the email invitation to be taken to the online customer survey; (ii) complete all questions in the online customer survey; (iii) provide a contact email address, which must be the email address to which Promoter’s survey invitation was sent; (iv) click to accept these Terms and submit the survey response. 

7. Survey response guidelines: The content of the participant’s survey response (whether positive or negative) will not in any way affect the participant’s chances of winning. However, the survey response must be completed in good faith and reflect the honest beliefs of the participant. Survey responses must not be, or contain any material which is or is likely to be considered: offensive; abusive; threatening; defamatory; obscene; indecent; sexually explicit; violent; discriminatory based on race, sex, religion, nationality, disability, sexual orientation or age; false; misleading; or otherwise unlawful. Survey responses must not infringe any person’s intellectual property rights, right of confidence, right of privacy, right under data protection legislation or any other legal right. Any survey response that Promoter considers to be in breach of these guidelines will be disregarded and the participant’s entry will be disqualified.

8. Prizes: There will be five (5) winners in this Promotion, each of whom will win a £50 Amazon Gift Card (digital only). Amazon Gift Cards are subject to the terms and conditions at https://www.amazon.co.uk/gp/help/customer/display.html?nodeId=GNG9PXYZUMQT72QK. Each winner should ensure they are familiar with all applicable terms and restrictions, including any applicable expiry dates and other limitations on use. 

9. Prize substitution: Prizes are non-transferable, non-refundable, non-exchangeable and no cash alternative is available. However, if Promoter considers it appropriate, or if it becomes necessary for reasons beyond Promoter’s control (e.g. if a prize becomes unavailable for any reason), a prize may be varied or swapped for a suitable alternative in Promoter’s discretion. 

10. Winner selection: All eligible entries will be entered into a random prize draw to select the winners within six (6) days of the end of the Entry Period. 

11. Winner notification and delivery of prizes: Winners will be notified by email using the email address provided at the time of entry. Winner notifications will be sent within six (6) days of the completion of the winner selection process. The email notification will include the £50 Amazon Gift Card as a digital code.   It is each winner’s responsibility to keep their digital code safe, and no duplicate or replacement will be sent.

12. Forfeiture and substitution: It is each winner’s responsibility to monitor their email address (including spam folder) for receipt of the win notification. If Promoter receives an “undelivered” notification, Promoter will make two (2) further attempts to deliver the win notification to the winner using the same email address. If the win notification remains undelivered after three (3) attempts, no further attempt to contact the winner will be made. In these circumstances, the winner will forfeit their prize and Promoter reserves the right to select a substitute winner  , using the same process as the original winner selection process.

13. Liability: Nothing in these Terms limits or excludes any person’s liability for death or personal injury caused by their negligence, for fraud, for breach of the Consumer Rights Act 2015, or for any other matter in respect of which liability cannot be lawfully limited or excluded. Subject to this, Promoter and Promotion Administrator will not be liable for any loss or damage any participant suffers as a result of their participation in the Promotion and receipt or use of a Prize in circumstances where: (i) there has been no breach of a legal duty of care owed to the participant by Promoter or Promotion Administrator; (ii) the loss or damage was not caused by a breach of these Terms by Promoter or Promotion Administrator; (iii) it was not obvious that the participant would suffer such loss or damage and nothing the participant said to Promoter or Promotion Administrator before entering this Promotion meant that Promoter or Promotion Administrator should have expected it to happen (so, in the law, the loss was “unforeseeable”); (iv) the participant could have avoided the loss or damage suffered by taking reasonable action; (v) the loss or damage was caused by any event or circumstance beyond Promoter’s or Promotion Administrator’s reasonable control; or (vi) the loss or damage was caused by the unavailability of Promoter’s or Promotion Administrator’s websites, apps or social media accounts. In addition, this Promotion is only open to consumers and therefore Promoter and Promotion Administrator will not be liable for any business losses, such as loss of profits or revenue, loss of anticipated savings or loss of goodwill. 

14. No endorsement: The Promotion is in no way sponsored, endorsed, administered by or associated with Amazon or any other third party. By participating in the Promotion, participants are providing information to Promoter and Promotion Administrator, not to Amazon or any third party. All third-party trade marks and other intellectual property rights are hereby acknowledged.

15. Cancellation and variation : Promoter reserves the right to vary, suspend or cancel the Promotion and/or these Terms if it considers it necessary or appropriate to do so, including if there is any actual or anticipated breach of applicable law or if variation, suspension or cancellation is necessary due to an event outside Promoter’s reasonable control. In the event of cancellation, Prizes may be awarded to winners drawn from entries received prior to cancellation.

16. Disqualification  : Without limiting the options available to Promoter, Promoter reserves the right at any time to disqualify entries or participants that Promoter regards as being in breach of these Terms, any applicable laws, any terms and conditions referred to in these Terms and/or the spirit of the Promotion. 

17. Interference with the Promotion: Any attempt to damage or undermine the content or legitimate operation of the Promotion is prohibited and may also be a violation of criminal and/or civil laws. Promoter reserves all its rights and remedies to deal with breaches or suspected breaches of this section including, without limitation, to exclude any participant or winner believed to be associated with such activity.

18. Publicity: By entering the Promotion, each participant agrees that, in the event of a win, Promoter shall be entitled (but not obliged) to announce their names (and/or social media handles if applicable) on Promoter’s websites and social media. Participants may also be asked (without further reward) to take part in reasonable publicity connected with the Promotion. 

19. Disclosure of winner’s details : By entering the Promotion, each participant acknowledges that, in the event of a win, their surname and county of residence may be disclosed to persons enquiring, where permitted by law. Any participant may object to their information being made available in this way, or may request that the amount of information made available be reduced, by contacting Promoter using the contact details at the end of these Terms. In these circumstances, the participant acknowledges that Promoter may nevertheless disclose the relevant information, and the participant’s entry, to the Advertising Standards Authority (and/or any other competent authority) if required to do so. By way of example, this may happen where Promoter is required to demonstrate that it has awarded any advertised prizes. To request disclosure of winner details, enquirers must submit a request to researchsupport@linney.com within one (1) month following the end of the Entry Period. Details will only be disclosed (if permitted by law) after all prizes have been awarded. 

20. Personal data : The survey is being conducted by the Promotion Administrator on behalf of the Promotor. Responses to the survey will be used to develop and improve the My McDonald’s App (“App”). Survey responses may also be used to generate insights and carry out analytics about how participants engage with the survey. If a participant has signed up to MyDonald’s Rewards, the participant’s survey responses may be combined with other information about the participant’s App use, including but not limited to order history, to enhance the participant’s survey responses and the effectiveness of App developments and improvements. Where personal information is used in this way, the personal information will not be used to directly identify the participant and will be used together with information relating to other individuals that completed the survey. Information about a participant’s completion or non-completion of the survey will be used to administer the Promotion. 21. Accessing these Terms: Any website on which these Terms are posted is only intended to be accessed from the United Kingdom (England, Wales, Scotland and Northern Ireland) and where permitted by law. Promoter makes no representation that materials relating to the Promotion are appropriate or available for use in other locations. Access to them from locations where their contents are illegal is strictly prohibited.

22. Severance and waiver: If any part of these Terms is or becomes invalid, unenforceable or illegal, the validity, enforceability and legality of the rest of these Terms will not be affected. Promoter’s failure to enforce any provision of these Terms will not constitute a waiver of that provision.

23. Disputes: Subject to the “Law and Jurisdiction” section below, if there is a dispute about the Promotion or these Terms, Promoter’s decisions are final. If there is a conflict between these Terms and any other document referred to in these Terms, these Terms take precedence to the extent necessary to resolve the conflict.

24. Law and jurisdiction: The Promotion and these Terms are governed by English law, and any disputes arising in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that residents of Scotland and Northern Ireland may also bring proceedings in their own jurisdiction.
